2. STUD FEE

The agreed stud fee is: $1,800.00

Payment terms: Full fee due at time of service.

Accepted payment methods: Personal cheque or Zelle.

3. TIE GUARANTEE

The Stud Owner guarantees that a natural tie (copulatory lock) of at least 5 minutes was observed and witnessed during the breeding on March 15, 2026 (and a repeat tie on March 17, 2026).

A witnessed tie was achieved on both breeding dates.

The Stud Owner does NOT guarantee pregnancy or live puppies as a result of this service.

4. RETURN SERVICE POLICY

If Whitfield's Morning Frost does not produce at least one live puppy as a result of this service, the Stud Owner (James Hartwell) agrees to provide ONE (1) return service under the following conditions:

a. A negative pregnancy result must be confirmed by a licensed veterinarian via ultrasound or relaxin blood test, with written documentation provided to the Stud Owner no later than 35 days post-breeding.

b. The return service must be used within 12 months of the original breeding date (by March 15, 2027), subject to Silver Line's Midnight Commander's health and availability.

c. The return service applies to Whitfield's Morning Frost only and is not transferable.

d. The return service is voided if breeding failure is attributed to the Dam's documented infertility or the Dam Owner's failure to time the breeding correctly with progesterone testing.

e. If Silver Line's Midnight Commander is deceased or retired before the return service is used, a full refund of $1,800 will be issued to the Dam Owner.

5. BRUCELLOSIS TESTING

Stud Dog brucellosis test date: March 1, 2026 — Result: Negative Dam brucellosis test date: March 10, 2026 — Result: Negative

Both tests performed by licensed veterinarians. Copies of test results are attached.

6. VACCINATION REQUIREMENTS

7. PICK OF LITTER

This clause DOES NOT apply. The stud fee is cash only ($1,800) as described in Section 2.

8. LITTER REGISTRATION

The resulting litter will be registered with the American Kennel Club (AKC) by the Dam Owner (Carol Whitfield).

James Hartwell agrees to sign the AKC Stud Service form within 10 business days of Carol Whitfield's request.

James Hartwell does not retain co-ownership of the Dam, the litter, or any individual puppy by virtue of this agreement.

10. LIMITATION OF LIABILITY

The Stud Owner's total liability under this Agreement shall not exceed $1,800 (the stud fee paid). Neither party shall be liable for consequential or incidental damages.

11. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Montana. Any unresolved disputes shall be subject to small claims court in Gallatin County, Montana.

12. ENTIRE AGREEMENT

This document constitutes the entire agreement between James Hartwell and Carol Whitfield regarding this breeding of Silver Line's Midnight Commander × Whitfield's Morning Frost. No verbal agreements are binding.

What This Sample Shows You

Section 3 (Tie guarantee): The stud owner confirmed two breeding dates, not just one. Two breeding sessions 48 hours apart is common practice and improves conception rates.

Section 4 (Return service): The 35-day documentation deadline protects the stud owner from late or vague claims. The voiding clause for improper timing is fair and standard — the stud owner is not responsible for missed ovulation.

Section 9 (Health testing): All test results are listed with dates, results, and the verification method. "OFA Good hips" with no date is not sufficient — a serious contract includes the date so you know how current the testing is.
